1. Acceptance of Terms

By registering for an account, accessing, or using EventQRCard (the "Platform", "we", "us", or "our"), or by scanning a QR code to upload media, you agree to be legally bound by these Terms. If you do not agree, you must immediately cease all use of the Platform.

2. Eligibility

Hosts: You must be at least 18 years of age to register as a Host, purchase an event package, or manage any event on the Platform. By registering, you represent and warrant that you are at least 18 years old and have full legal capacity to enter into a binding contract under Romanian law.

Guests: Guests who upload media via QR code must be at least 16 years of age. Under Romanian law implementing GDPR Article 8, 16 is the minimum age for valid digital consent to data processing. Guests between the ages of 16 and 17 may use the Platform independently. Guests under 16 may not upload media under any circumstances. The Host is solely responsible for preventing minors under 16 from scanning the event QR code or submitting uploads. The Platform cannot technically verify a Guest's age at the point of upload; this responsibility rests entirely with the Host.

3. Description of Service and Platform Immunity

The Platform is a temporary, automated digital hosting conduit designed to facilitate the collection of photographs and videos ("User Content") by event organizers ("Hosts") from their invitees ("Guests").

Neutral Conduit: We are a neutral technology provider and do not create, modify, or direct the User Content uploaded.

Developer Status: You acknowledge that this Platform is maintained by an individual developer based in Romania, not a corporate entity. This does not limit your legal rights under applicable law, including GDPR.

No Warranty on Availability: The Platform is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted, error-free, or continuously available service. Planned or unplanned maintenance may cause temporary unavailability. We are not liable for any loss resulting from downtime.

4. User Responsibilities and Liability

Legal Responsibility: Whether you are a Host or a Guest, you are solely and entirely legally responsible for the User Content you upload. You must ensure that your use of the Platform complies with all applicable laws and in the jurisdiction where the event takes place.

Consent of Depicted Persons: The consent required is not only the uploader's own consent to use the Platform, but explicit, informed, and freely given consent from every individual who appears in the uploaded media — regardless of whether that person is the uploader or a third party. You may not upload photos or videos that contain identifiable images of other people without their prior knowledge and consent. For events attended by large groups (such as weddings or baptisms), the Host bears primary responsibility for ensuring that all attendees are informed that photographs may be taken and uploaded to the Platform before the event begins. A general announcement or visible notice at the event venue is strongly recommended and may be legally required in your jurisdiction. Uploading media depicting an individual who has not consented, who has objected, or who is not aware that their image is being collected constitutes a violation of these Terms and may constitute a violation of GDPR and Romanian personal data protection law, for which the uploader and/or Host are solely and entirely liable.

Consent: You represent and warrant that you possess explicit, freely given, and legally verifiable consent from every individual appearing in your uploads. This is especially critical under GDPR Articles 6 and 9, where facial images may constitute biometric data.

Host Ownership and Content Responsibility: The Host is the designated owner and custodian of the event gallery and all User Content uploaded to it. This means the Host bears full legal responsibility for the content that accumulates in their event dashboard. The Host must actively monitor their event gallery and is required to report and immediately delete any User Content that they identify as illegal, prohibited under these Terms or the AUP, uploaded without the consent of the depicted person, or otherwise harmful. The Host's obligation to monitor and report is ongoing throughout the 60-day content retention window. Failure to act upon known prohibited content is itself a violation of these Terms. The Platform provides manual deletion tools in the Host dashboard precisely for this purpose; Hosts must use them without delay upon identifying any problematic upload.

Prohibited Content: You must not upload any content that is illegal, defamatory, violates third-party intellectual property rights, contains malware, or is otherwise prohibited under our Acceptable Use Policy ("AUP"), which is incorporated into these Terms by reference.

Indemnification: You agree to indemnify, defend, and hold harmless the Platform and its developer from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your User Content; (b) your use of the Platform; (c) your violation of these Terms; or (d) your violation of any third-party right, including without limitation any privacy, consent, or intellectual property right.

Limitation of Liability: To the maximum extent permitted by Romanian law and applicable EU regulations, the Platform's total aggregate liability — whether in contract, tort, negligence, strict liability, or any other legal theory — to any Host, Guest, or third party for any and all claims arising from or related to these Terms, the Platform, or any event hosted through the Platform, shall under no circumstances exceed the total amount actually paid by the Host for the specific event service directly giving rise to the claim. This cap applies in aggregate across all claims arising from a single event, regardless of how many claims are brought, by how many parties, or on what legal basis. In no event shall the Platform or its developer be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to: loss of data, loss of profits, loss of revenue, loss of goodwill, emotional distress, or any damages resulting from unauthorized access to or alteration of User Content — even if the Platform has been advised of the possibility of such damages. You expressly acknowledge that the event fee you paid reflects the allocation of risk set out in this clause, and that the Platform would not be able to offer the service at this price without this limitation.

5. Refunds and Payments

Merchant of Record: All payments are handled exclusively by a third-party Merchant of Record (MoR). The MoR is the legal seller of record for all transactions and is responsible for collecting payment, issuing receipts, and handling applicable taxes (including VAT). Your payment relationship is governed by the MoR's own terms and privacy policy.

Refund Policy: All sales are final. Refunds are only processed for verifiable technical failures (e.g., total server outage). Refund requests must be submitted to [email protected] within 7 days of the event date.

Exclusions: We do not provide refunds for host error, guest error, lack of internet at the venue, low Guest participation, or events cancelled by the Host.

6. Content, Data Lifecycle, and Deletion

60-Day Policy: User Content is automatically and permanently deleted 60 days after upload. This deletion is irreversible. Hosts are solely responsible for downloading their media before the expiry of this period.

Retrieval: We are not responsible for media that cannot be retrieved after this period; Hosts must download their media immediately.

Manual Deletion: Hosts may manually delete their entire event and all associated User Content at any time via the Host dashboard.

EXIF and Metadata Scrubbing: As a privacy-by-default measure, our backend automatically strips all EXIF metadata (including GPS location, camera model, and timestamps) from all uploaded photographs and videos.

7. Intellectual Property

Guests retain ownership of the photos and videos they upload. By uploading, Guests grant the Host a non-exclusive, royalty-free license to view and download the User Content for personal event-related purposes. We do not claim any ownership rights over User Content. We are granted a limited technical license to store and transmit User Content solely as necessary to provide the Service.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this document. For registered Hosts, we will send notification of material changes to the email address on file at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

9. Force Majeure

We shall not be held liable for any failure or delay in performance of our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to: acts of God, war, civil unrest, epidemic or pandemic, government action, internet service provider failures, cyberattacks, or third-party infrastructure failures (including Cloudflare or payment processor outages).

10. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms, the AUP, or is harmful to other users, us, or third parties. Upon termination of a Host account, all associated User Content will be scheduled for immediate permanent deletion.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and us regarding your use of the Platform and supersede all prior agreements relating to the same subject matter.

13. Governing Law and Jurisdiction

Law: These Terms are governed by the laws of Romania, including applicable European Union regulations (including GDPR).

Venue: You consent to the exclusive jurisdiction of the courts in the developer's city of residence in Romania.

Consumer Rights: Nothing in these Terms limits your statutory rights as a consumer under Romanian law or applicable EU consumer protection legislation, including your right to file complaints with the Romanian National Authority for Consumer Protection (ANPC) or with the supervisory authority in your EU member state of residence.
