This Acceptable Use Policy ("AUP") outlines the standards for uploading media and using EventQRCard. This policy is designed to protect the platform, its users, and the developer's infrastructure. This AUP is incorporated by reference into the Terms of Service and forms part of the binding agreement between you and the Platform.
Age Restriction: Only individuals who are at least 16 years of age may upload media as Guests. Only individuals who are at least 18 years of age may register as Hosts. By using the Platform in any capacity, you confirm that you meet the applicable age threshold. Hosts are solely responsible for ensuring that no one under the age of 16 submits uploads to their event.
1. Illegal and Prohibited Content
You are strictly prohibited from using the Platform to upload, store, or share any content that:
- Violates Local or International Law: Includes any material that is illegal under the laws of Romania or the jurisdiction where the event takes place.
- Child Exploitation: We have an absolute zero-tolerance policy for any content depicting the sexual exploitation of minors (CSAM). Any such content will be immediately and permanently removed. The uploader's information will be reported to the Romanian National Police (IGPR) and relevant international authorities (including the Internet Watch Foundation). We will cooperate fully with law enforcement. This is not merely policy — it is a legal obligation under Romanian and EU law.
- Non-Consensual Imagery: Includes "revenge porn" or any media uploaded without the explicit, verifiable consent of the subjects involved. This prohibition applies regardless of the relationship between the uploader and the depicted person.
- Absence of Consent of Depicted Persons: Uploading a photo or video in which another identifiable person appears, without that person's prior knowledge and consent, is strictly prohibited. Consent must be freely given, specific, and informed — a general assumption that "everyone at a public event consents to being photographed" does not satisfy this requirement for the purposes of GDPR or this AUP. If a person depicted in an uploaded file later withdraws their consent or objects to their image being stored on the Platform, the uploader and the Host must act immediately to delete the relevant media.
- Hate Speech and Harassment: Includes content that promotes violence, incites hatred, or harasses individuals based on race, religion, gender, or disability.
- Infringing Material: Includes any media that violates third-party intellectual property, including copyrights, trademarks, or privacy rights.
- Defamatory Content: Material designed to harm the reputation of an identifiable individual without factual basis.
2. Permitted File Types and Technical Limits
Only the following file types may be uploaded:
- Photos: JPEG (.jpg, .jpeg), PNG (.png), WebP (.webp), HEIC (.heic)
- Videos: MP4 (.mp4), MOV (.mov), AVI (.avi), WebM (.webm)
Files that do not conform to permitted types will be automatically rejected. Attempts to disguise prohibited file types by changing their extension are a violation of this AUP. File size limits remain: 200MB per photo, 5GB per video.
3. System and Infrastructure Integrity
To ensure the stability of the service and the security of our Cloudflare R2 storage, you may not:
- Circumvent Limits: Attempt to bypass individual file size limits (200MB for photos, 5GB for videos) or total event storage quotas.
- Malicious Code: Upload files containing viruses, trojans, worms, or any other malicious software designed to disrupt the service.
- Network Attacks: Engage in activities that interfere with or disrupt the platform’s servers or networks, including DDoS attacks.
- Automated Access: Use bots, scrapers, or automated tools to access the platform or bulk-download User Content without authorization.
- Unauthorized Access: Attempt to access Host dashboards, event galleries, or any data that does not belong to you.
4. Account and Host Responsibilities
- Content Ownership and Custodianship: The Host is the designated owner and legal custodian of the event gallery. By creating an event on the Platform, the Host accepts full legal responsibility for all User Content uploaded to that event. The Platform acts solely as a neutral technical conduit; it does not review, curate, or supervise uploaded content. The responsibility for what exists in an event gallery rests with the Host, not the Platform.
- Active Monitoring Obligation: Hosts have an ongoing duty to monitor their event gallery throughout the 60-day retention window. This includes reviewing uploaded content for compliance with these Terms and this AUP. Hosts may not remain passively uninvolved in their event gallery after the event concludes. If a Host becomes aware — through any means — that their gallery contains prohibited, illegal, or non-consensual content, they are obligated to act immediately.
- Mandatory Reporting and Deletion: If a Host discovers or is notified of any content in their event gallery that is illegal (including CSAM, non-consensual intimate imagery, or content inciting violence), the Host must: (1) immediately delete the content using the Host dashboard deletion tools; and (2) report the content and uploader details to the Platform at [email protected] and, where legally required, to the appropriate Romanian or international law enforcement authority. Failure to report known illegal content may itself constitute a criminal offence under Romanian law. The Host must not wait, delay, or seek further confirmation before deleting content that is clearly illegal or prohibited.
- Commercial Honesty: Hosts must not use the platform for fraudulent purposes or to deceive guests.
- Consent Management: Hosts are responsible for obtaining and documenting appropriate consent from all event attendees before directing them to upload media. Before the event, Hosts should notify attendees — via invitation, event programme, or visible signage at the venue — that an automated photo-sharing platform will be in use, that uploaded media will be stored for up to 60 days, and that attendees may request deletion by contacting the Host. This is especially important at events where photos of minors may be taken.
- Lawful Use: Hosts must not use collected media for commercial purposes without the explicit, documented consent of all depicted individuals.
5. Enforcement and Termination
We reserve the right to determine, at our sole discretion, whether User Content violates this AUP.
- No Obligation to Monitor: We do not proactively monitor User Content for violations. Our enforcement actions are reactive, based on reports or automated technical triggers.
- Immediate Deletion: Violating content may be permanently deleted without prior notice.
- Account Termination: We reserve the right to terminate the accounts of Hosts who violate these terms, with no obligation to provide a refund.
- Legal Cooperation: We will cooperate with law enforcement authorities in Romania and internationally if illegal activity is suspected.
